CONCLUSION AND CANCELLATION OF SALE AGREEMENT
The subject and the commercial purpose of the Contract is the purchase of selected products or services through online shop Optika Luna with payment appropriate fees – price of the product or service. The Contract is concluded by the means of distance communication (Contract concluded at a distance) and by telephone with human intervention and without it, and the Internet.
It comes into force and shall be binding from the moment the user accepts the offer of Optika Luna on one of the following ways:
– selects payments and fulfilling orders as a registered user of webshop Optike Luna,
– selects payments and fulfilling orders as a guest user of webshop Optike Luna,
– selects payments and fulfilling orders through the phone lines or by e-mail.
In the process of registration or creation a user account, the user is required to choose the user name or the name, under which he/she will perform the services, and choose a security password and provide a valid e-mail address. All data required for registration or creating a user account must be true; it is expressly prohibited using or application other people’s data.
Registration or user account are created just for one person and it is not allowed to transmit information on the registration or account to third parties. User is obliged to keep information about their security password and account. It is not permissible to use someone else’s registration or account.
For violation of the provisions of the Terms of this chapter, Optika Luna reserves the right, in its discretion, to extinguish the registration or user account without any compensationof the cost or damage to the user.
By registration (including payment services) the Contract between Optika Luna and buyer (user) is considered to be concluded.
Contract is valid from the moment when user make the registration, that is from the day when he/she accepts the offer for conclusion this Contract.
On the occasion of the conclusion of the Contract, User shall receive: confirmation of a concluded contract, that is pre-contractual information referred from Article 57 para. 1. of the Consumer Protection Act (National newsppaper no. 41/2014), these Terms and information about the right of users on the unilateral termination of Contract with the Form of unilateral termination of the Contract under Article 61 para. 1 and 2 of the Consumer Protection Act.
The user can unilaterally terminate the Contract within 14 (fourteen) days without giving a reason.
The user has no right to unilaterally terminate the Contract:
– if the service is completely filled, and the fulfillment began with his express prior consent and with his confirmation that he is familiar with the fact that they will lose the right to unilaterally terminate the Contract if a service is completely filled,
– if the subject of the Contract are goods with which he is not satisfied because he changed his mind on the type of product, and the product is in its original, undamaged packaging and also is undamaged,
– if the subject of the Contract are goods which are, because of its nature after delivery, inseparably mixed with other things.
To being able to exercise the right to unilaterally terminate the Contract, user must notify Optika Luna of his decision to unilaterally terminate the Contract before the end of deadline and with unambiguous statement sent by post (on Očna optika LUna Ltd., J. Slavenskog 1, 10110 Zagreb), by fax to 01 / 3882 376 or by e-mail at firstname.lastname@example.org, in which you state your name, address, telephone number, fax number or email address, and also can use given a written form for unilateral termination of the Contract.
Also, the Form of unilateral termination of the Contract user can electronically fill out and send, in which case Optika Luna will, without delay, submit him a receipt notice of unilateral termination by e-mail.
The deadline for unilateral termination of the Contract is 14 (fourteen) days from the date when are the goods or services, which are the the subject of this Contract, submitted in possession to the user or a third party designated by the user, and which is not a carrier.
If the user unilaterally terminates the Contract, Optika Luna will refund to him payment that we received, including the cost of delivery (if in his case apply), without delay, and no later than fourteen (14) days from Optika Luna receives the user’s decision to unilaterally terminate the Contract, unless the user has selected a different type of delivery, which is not the cheapest standard delivery that is offered.
Refunds will be made in the same way that the user has paid for. If the user agrees otherwise, he does not bear any costs in relation to the refund. Refunds Optika Luna can perform only after the goods are returned or after we received a proof that the goods were sent back.
User is obliged to deliver the goods or send it to the Očna optika Luna Ltd., J. Slavenskog 1, 10110 Zagreb, without undue delay, and in any event not later than 14 (fourteen) days from the date when he handed over to Optika Luna its decision to unilateral termination of the Contract. The direct cost of returning the goods shall be borne by the user himself. Shipping is free for orders up to 500,00 kn or higher, and below that amount, price is 30,00 kn. Shipping goes through GLS and you may expect little delay because of COVID-19 situation. International shipping it may last a few days longer, but for now is canceled because of coronavirus pandemic situation. Shipping goes on adress that you left us when you where entering your shipping adress. For international shipping the price is different and depends on the distance, it’s not free. RECLAMATIONS AND COMPLAINTS
Ordered products are packaged in a way that ordinary manipulation in transport / delivery can not damage them. The buyer is obliged when taking over the package to check packing shipments. If the packaging of the consignment has visible damage / defects, we recommend that the buyer refuses to receive the same, because there is a possibility that the product inside the packaging is also damaged. By refusing the receipt, delivery service will return the shipment to Optika Luna, noting that the consignment contains disadvantage.

In the case of justified complaint we allow the termination of the contract with refund or replacement of the product. In case of damage and / or malfunction of the delivered goods, the buyer should send a photo of that complaint in order to take account of the same, on the basis of physical evidence. Optika Luna collect damaged, defective or incorrectly delivered goods at his own expense, if it is determined that the reclamation is valid and that the buyer did not affect the malfunction, damage or any defect of goods. In the case of justified complaint within the time limits prescribed by the Law on Obligations, the full replacement cost of the product with a new one fully bears Optika Luna.
In the event of a dispute over the justification of the complaint and / or the way the product is returned (the product must be unused, in the unchanged amount and in its original packaging, with the original bill presented and the warranty, if any exist) product will be given to expert witnesses or expert legal entity. Insofar as the complaint and the resulting expertise came before the expiry of 6 months from the date of submission of the product to the customer, the cost of expertise, regardless of the outcome, bears Optika Luna in its entirety. In the event that the expert testimony establishes justification for complaint, all the cost of replacing the expertise and product bears Optika Luna, and in the case of unjustified complaint sent after the expiry of 6 months from the date of submission of products to customers, the cost of expert testimony on the same complaint shall be borne by the buyer.

GUARANTEE FOR CORRECTNESS OF SOLD PRODUCTS AND SERVICE

Products for which we offer a warranty are in accordance with the law and guarantee specified by certain manufacturers and they have a warranty card. The right to use the guarantee is achieved by original receipt and warranty card. The buyer shall keep the warranty card and receipt. The date of inssuance of receipt is the beginning of the activation of guarantees. Očna optika Luna d.o.o. retain the right of changing prices, without previous notification and won’t be responsable for any consequences resulted by these changes. Prices include tax and apply only on online shopping. They are expressed in croatian kunas.
All payments will be effected in Croatian currency. The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Croatian kuna according to the current exchange rate of the Croatian National bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated in our web site.
